Article: definitions

PADELWORLD BV:

The PADELWORLD BV, with registered office at BE-8200 Sint-Andries, Pierre Debbautstraat 6, registered with the Crossroads Bank for Enterprises (Kruispuntbank van Ondernemingen) under the number 0761.625.984. PADELWORLD BV is the manager of STOETEL BV.

STOETEL BV:

The STOETEL BV, with registered office at BE-8200 Sint-Andries, Pierre Debbautstraat 6, registered with the Crossroads Bank for Enterprises (Kruispuntbank van Ondernemingen) under the number 0747.962.347, operating under the name ARENAL GRIMBERGEN. At BE-1853 Grimbergen, Antwerpselaan 1 (bus 0003), STOETEL BV organises sports and other events, for businesses and private individuals, mainly: trampoline and padel.

General terms and conditions:

These general terms and conditions, in whatever form they are published (for example via the website of STOETEL BV / PADELWORLD BV.

 

Cancellation:

The written notification that no further use or partial use will be made of one or more agreed products and/or services, or that the Agreement will not be or only partially implemented.

 

Client:

The natural or legal person who requests the organisation of the Activity or who has requested a quotation.

 

Activity:

All the services and facilities offered by STOETEL BV / PADELWORLD BV: trampolining and padel.

 

Participant:

Any natural person who participates in the Activities organised by STOETEL BV / PADELWORLD BV.

 

Minor Participant:

Participant who has not yet reached the age of 16 years.

 

Accompanying person:

Natural person who accompanies the Minor Participant before, during and after the Activity.

 

Gift card:

Gift card available to buy from STOETEL BV / PADELWORLD BV, which is intended to be used as payment for the purchase of (paid) products and/or services.

 

Voucher:

Voucher issued by STOETEL BV / PADELWORLD BV or with cooperating parties, which is intended to be used as payment for the purchase of (paid) products and/or services, only valid for the specifically mentioned products and/or services.

 

Gift voucher:

A marketing or promotional voucher issued by STOETEL BV / PADELWORLD BV, which is intended to be used as payment for the purchase of (certain) products and/or services, only valid for the specifically mentioned products and/or services.

 

Discount voucher:

A voucher issued by STOETEL BV / PADELWORLD BV, which is intended to be used as (partial) payment for the purchase of (certain) products and/or services, only valid for the specifically mentioned products and/or services.

Article 2: applicability

Unless otherwise agreed in writing, these general terms and conditions apply to all quotes and agreements entered into by STOETEL BV / PADELWORLD BV. By making a booking (online or by signed quote, see infra), the Client expressly acknowledges that they have read and approved the general terms and conditions of STOETEL BV / PADELWORLD BV in advance.

 

The invalidity of an article in the general terms and conditions does not affect the other part of the general terms and conditions. By paying at the checkout, making a booking, signing an Agreement with STOETEL BV / PADELWORLD BV and/or using (one of) the products and/or services of STOETEL BV / PADELWORLD BV, the Visitor automatically agrees with the content and applicability of the general terms and conditions.

Article 3: concluding the agreement - booking an activity

Online:

An agreement is only concluded when STOETEL BV / PADELWORLD BV has received the booking payment after the Client has booked an Activity using the order form on the website. On receipt of this amount, the Client will receive a confirmation e-mail from STOETEL BV / PADELWORLD BV stating the chosen Activity, the chosen number of Participants for the Activity, date and hour on which the Activity is booked, etc.

 

Offline:

Any quote issued by STOETEL BV / PADELWORLD BV is not binding until it has been accepted by the Client, but STOETEL BV / PADELWORLD BV reserves the right to amend the quote at any time. Unless expressly stated otherwise, each quote issued by STOETEL BV / PADELWORLD BV has a limited period of validity of 14 calendar days, after which it only has informative value. Unless agreed in writing, the agreement is only concluded after receipt by STOETEL BV / PADELWORLD BV of a signed and unchanged quote or order form. The Client undertakes to pay the total amount of the Activity before the start of the chosen Activity.

Article 4: prices

The prices applied by STOETEL BV / PADELWORLD BV for courses, lessons or services include VAT and are per person, unless otherwise stated.

Article 5: payments

All invoices issued by STOETEL BV / PADELWORLD BV are payable in full, without discount, unless agreed otherwise in writing. The invoices are payable prior to the Activity, unless otherwise agreed. In the event of non-payment, default interest amounting to 10% a year is due by operation of law and without notice of default. Furthermore, conventional damages of 10% of the total price are due, with a minimum of €125.00. Even in the case of partial payment, the entire amount of the damages is due.

Article 6: obligations of the participants

The Client undertakes to inform all the Participants in the Activity booked by them of the following obligations and guidelines in advance.

a. All Participants - General obligations

STOETEL BV / PADELWORLD BV expressly reserves the right to exclude Participants from an Activity if they feel that the Participant is not capable of participating in the Activity.

Participants behaving inappropriately or having difficulties may be excluded from participating by STOETEL BV / PADELWORLD BV.  The exclusion of a Participant from an Activity by STOETEL BV / PADELWORLD BV may never give rise to any repayment of paid deposits and/or prices or to reduction of the agreed price.

b. All Participants - Due diligence

The Participant is obliged to give a fair presentation of the situation and answer relevant questions truthfully.

The Participant must follow the instructions of (the staff) at STOETEL BV / PADELWORLD BV at all times, and the Participant is not permitted to act in conflict with a ban or warning.

The Participant may not use or take part in activities of STOETEL BV / PADELWORLD BV if he/she is under the influence of alcohol and/or narcotics.

c. Trampoline Participants - Specification obligations

Before the start of the trampoline activity, every Participant is required to sign a document in which he or she expressly acknowledges the risks associated with trampolining as well accepting and declaring their willingness to comply with the house rules.  Refusal to sign this document gives STOETEL BV / PADELWORLD BV the right to exclude the Participant from participation.

Only the instructor associated with STOETEL BV / PADELWORLD BV may give instruction, training or coaching on the trampolines of STOETEL BV / PADELWORLD BV.

d. Trampoline Participants - Minor Participants

Minor Participants (aged 2 to 6 inclusive) will always be accompanied by an adult and/or supervisor. Minor Participants (aged 6 to 15 inclusive) may only take part in the Activities following receipt of a consent form signed by a parent or legal guardian in advance. With respect to the children's packages, supervision is required at all times, even if some participants are older than 6.

e. Trampoline Participants - Due diligence

Under penalty of exclusion of the Participant, it is strictly forbidden to bring in drink, sweets, food and/or tobacco products into the trampoline area. Sharp and/or loose objects, including phones, cameras, keys and jewellery, may not be brought in or worn. STOETEL BV / PADELWORLD BV requires the Participant to use equipment provided in time and with care and to return them in good condition.

The Participant is liable for damage to equipment provided.

Article 7: gift cards, vouchers, gift vouchers and discount vouchers

Gift cards must be paid in full in advance, unless otherwise agreed with STOETEL BV / PADELWORLDD BV.

Gift cards may be used for the products and/or services of STOETEL BV / PADELWORLD BV that are presented at that moment in brochures or on the website of STOETEL BV / PADELWORLD BV.

No cash refunds of gift cards, vouchers, gift vouchers and discount vouchers will be made.

Issued gift cards, vouchers, gift vouchers and discount vouchers are valid for the period given and automatically expire at the end of the relevant period. At the end of the relevant period, the Participant cannot derive any rights from those gift cards, vouchers, gift vouchers and discount vouchers.

Extending the validity of a gift card, voucher, gift voucher and discount voucher is expressly reserved to the management or authorised person at STOETEL BV / PADELWORLD BV and is only considered following a written request addressed to the management, so long as this request reaches the management before or by the end date stated on the gift cards, vouchers, gift vouchers and/or discount vouchers.

The value of the gift card, vouchers, gift vouchers and/or discount vouchers is given in figures and, if possible, in words.

It is not permitted to reproduce, edit or amend the gift card, voucher, gift voucher and/or discount voucher. In the event of any violation of the above or any fraudulent use of the gift card, voucher, gift voucher and/or discount voucher, STOETEL BV / PADELWORLD BV reserves the right to reject the gift card, voucher, gift voucher and/or discount voucher and, without notification, to take (legal) measures against the person concerned.

Article 8: cancellation and amendment (cancellation)

Failure to be present on time or non-attendance is at the expense of the Participant.

After purchasing the Activity, the Client cannot cancel the session.

Cancellation of the chosen Activity can never give rise to any refund of the amounts paid or termination fee due.

If STOETEL BV / PADELWORLD BV is required to cancel a ticket purchased by the Client, the Client is free to claim the value of the cancelled ticket or to cash in the ticket at a later date.

Article 9: complaints

Complaints must immediately be reported to STOETEL BV / PADELWORLD BV. Complaints that are formulated later will be considered as non-existent. If a complaint is not handled satisfactorily on the spot, this must be sent by registered letter with reasons within 8 days of the end of the Activity to the registered office of STOETEL BV / PADELWORLD BV. Complaints received after this time will be considered as non-existent.

Formulating a complaint may never give rise to any repayment of the deposits and/or amounts paid for the Activity and will never give rise to a reduction of the invoiced amount.

Article 10: liability

In the event of an accident, loss, damage or theft, STOETEL BV / PADELWORLD BV or its Appointees are only liable for the damage resulting from a proved own fault, or negligence by STOETEL BV / PADELWORLD BV or its Appointees.

Any liability of STOETEL BV / PADELWORLD BV is always limited to the amount of its insurance coverage.

In the event of damage and/or vandalism to the equipment of STOETEL BV / PADELWORLD BV , the latter has the right to claim this from the Participant and/or Client.

Article 11: force majeure

STOETEL BV / PADELWORLD BV will never be liable, and therefore never held liable to compensate damage resulting from delays or implementation of its commitments, if the delay or shortcoming arose through force majeure. Force majeure relates here to all events that occur independently of the will of STOETEL BV / PADELWORLD BV.

STOETEL BV / PADELWORLD BV reserves the right to cancel the Activity in the event of force majeure, including for example: power failure, safety reasons (damage to equipment). In the event of such a cancellation, STOETEL BV / PADELWORLD BV undertakes to pay the amounts paid by the Client in their entirety, without STOETEL BV / PADELWORLD BV ever being liable to compensating more.

Article 12: privacy

With a view to delivering an optimal service, STOETEL BV / PADELWORLD BV collects personal data pertaining to the Client and the Participants which are provided via the website, e-mail, fax, phone, etc. Moreover, STOETEL BV / PADELWORLD BV records all the necessary data to enable the correct invoicing of the Activity booked. STOETEL BV / PADELWORLD BV uses cookies for online booking, which are accepted by the Client and/or Participants. All the information collected and saved by STOETEL BV / PADELWORLD BV is not shared with third parties, unless with the explicit permission of the Client.

STOETEL BV / PADELWORLD BV uses video cameras for safety reasons. For safety purposes, the images from these cameras will be saved for some time but not used for other purposes, unless with prior notification.

STOETEL BV / PADELWORLD BV has the right to take photos during the activities it offers. These may be published on its website and used for promotional purposes. If the Participant objects to this, he/she can notify STOETEL BV / PADELWORLD BV accordingly prior to participating in the activity.

Article 13: applicable law - competent court

Any dispute arising from the quotations or agreements entered into by STOETEL BV / PADELWORLD BV will exclusively be handled by the courts of Brugge. All disputes will be governed by Belgian law.
